Counseling is a good idea, because if you havee a place to vent and get emotional, you will be able to be more pulled-together when talking with admins and police.  You want to present as upset and horrified yet in control and sane yourself.  This can be hard to do when terrified, so get some emotional help outside HR or your department or colleagues.

It does seem true that if you are both female that the fact that he is stalking both of you, and the uni is allowing him to, makes it more a matter of sexual harrassment in the workplace.  This is a hostile workplace not just generally (for which there are often no legal protections) but specifically for women.  Talk to the women's center but be prepared for the fact that they may or may not have any power (mine was afraid their budget would be pulled if they got involved; head was mere staff and not tenured or politically powerful).

Get a better lawyer and let the uni know, as recommended upthread, that you are getting additional input.  Be vague about what that input is.
