Brewster Kahle Discusses the Future of ‘Orphan Works’

February 2, 2007, 2:35 pm

Brewster Kahle came out on the losing end of a recent appeals-court decision in Kahle v. Gonzalez (The Chronicle, February 2), a case through which he had sought to bring "orphan works" into the public domain. But Mr. Kahle, director of the Internet Archive, says his fight to remake the copyright system is far from over.

In an interview with CNET News, Mr. Kahle argues that the copyright issues broached in Kahle v. Gonzalez should ultimately be weighed by the Supreme Court and Congress, not by an appeals court. "What kind of world do we want in the digital era?" he asks. "Do we want to have libraries like we grew up with, ones with old and new books available to those that go to the library? Or do we only want what corporations are currently peddling?" –Brock Read
