A former football coach at Kansas State University has filed a countersuit seeking $3-million in damages against the university’s athletics corporation, claiming top officials, including the former president, were aware of a $3.2-million buyout he negotiated with the former athletics director, reports The Topeka Capital Journal. In May, Kansas State sued the coach, Ron Prince, seeking to invalidate an agreement he had struck with Robert Krause, the former athletics director. The university claimed Mr. Krause, who was also a long-serving vice-president at the university, negotiated the buyout in secret, but Mr. Prince’s lawsuit says Kansas State officials were aware of the deal.

Can the coach PROVE that other ranking decision makers (with authority to pull the plug) at the University knew of the agreement. There is a time tested legal principle that simply holds: “If you don’t have it in writing, you don’t have it.” Can he demonstrate by actually producing any written documents that show that they knew? If he can, he is the likely winner.

Maybe just enough proof to prevent case dismissal … with the anticipation of more proof (email, etc) being revealed in discovery.
