The Education Management Corporation asked a federal judge on Wednesday to dismiss a “whistle-blower” lawsuit against it that centers on the legality of how the for-profit college company compensated its student recruiters. The company argues that the suit, filed by two former employees in U.S. District Court in Pittsburgh and later joined by the U.S. Department of Justice and several states, “does not and cannot present any facts showing a companywide sham to defraud the government,” according to the Bloomberg news service and court documents.
