A new report from the U.S. Commission on Civil Rights concludes that using a model survey to gauge students’ interest in participating in sports is the best way for colleges to demonstrate compliance under a key prong of Title IX of the Education Amendments of 1972, the law banning sex discrimination at institutions receiving federal funds. The model survey, introduced in a 2005 clarification from the Education Department, has been the subject of fierce debate among advocates of gender equity, who say it constitutes a loophole that will stall women’s progress in athletics.
