Verdict Upheld
A federal judge has upheld a jury verdict requiring Xap Corporation to pay rival CollegeNET $4.5-million under an unfair competition lawsuit that was decided last year. U.S. District Judge Anna J. Brown, who tried the case in Oregon, found that Xap, a company that sells online admissions services, willfully deceived students by failing to tell them that their information would be shared with other companies, according to her court order (Adobe Acrobat required).
Xap was also ordered to pay CollegeNET’s attorneys fees, which could be as much as “several million dollars,” said Paul Casey, director of corporate communications for CollegeNET. The jury awarded CollegeNET an additional $4-million for patent infringement, but that decision must still be reviewed by the U.S. Patent and Trademark Office, Mr. Casey said. —Dan Carnevale
