U. of South Dakota Settles Donor Lawsuit Over Naming Rights

The University of South Dakota’s business school will keep its name, after settling a lawsuit with the widow of a major donor to the school, the Argus Leader, a Sioux Falls newspaper, reported today.

Lucy Buhler, the widow of Walter Buhler, a 1960 graduate of the business school, had argued in the lawsuit that the couple’s $9.2-million donation after Mr. Buhler died, in 1998, had secured the naming rights to the business school in perpetuity. The school, the Beacom School of Business, was renamed in 2006 after a $5-million gift from another donor.

Ms. Buhler asked to have $1.7-million of the original donation, which was earmarked for a new business-school building, returned for her to donate to a different cause. The USD Foundation refused, saying it had upheld the donation agreement by naming a new building in Mr. Buhler’s honor.

The case was settled this summer, under terms that have not yet been disclosed, and a U.S. District Court judge entered an order this month dismissing the lawsuit. —Kathryn Masterson
