The American Council on Education has issued a paper updating its legal guidance to colleges on affirmative action in response to the Supreme Court’s ruling in June in two cases involving race-based public-school assignment policies. Like an analysis of the Supreme Court’s decision issued in July by the College Board, the ACE paper says that colleges must show that the pursuit of diversity is important to their missions, that their policies have educational benefits, and that they have seriously considered ways to achieve diversity that do not involve taking applicants’ race or ethnicity into account. —Peter Schmidt
