The NCAA said today that it would not appeal a state judge’s decision over the weekend to enjoin it from enforcing a ban on the University of North Dakota’s “Fighting Sioux” nickname and logo, a policy that would have prevented the institution from playing host to a postseason-tournament game next weekend. According to the Associated Press, the NCAA concluded that there was not enough time to adjudicate the appeal before the scheduled game. The judge’s decision to grant the university’s request for a preliminary injunction may suggest how he will eventually rule in the case. At stake in the lawsuit is the NCAA’s ability to enforce a ban on nicknames, logos, and mascots bearing American Indian names that are deemed offensive.
