Jury Says Ball State Police Officer Is Not Liable in Student's Death

A federal jury this week found a former Ball State University police officer not liable in the 2003 shooting death of a student, Michael McKinney, The Indianapolis Star reported.

The officer, Robert Duplain, had already been cleared of criminal wrongdoing in the case, but Mr. McKinney’s family had sued him and the Ball State police chief for $100-million.

In the civil trial, Mr. Duplain maintained that Mr. McKinney, who was unarmed the night he died, had charged at him. The officer had responded to a 3 a.m. call about a stranger banging on the back door of a home near the university’s campus. He shot Mr. McKinney four times. The 21-year-old student, whose blood-alcohol level was quadruple the state’s legal driving limit, had confused the house for his friend’s, the Star said.

Ball State has paid most of Mr. Duplain’s legal fees, which total more than $1-million, according to the Star.

“There are no winners in this case,” Ball State officials said in a written statement. “This was a tragedy that deeply affected everyone involved.” —Sara Lipka
