Judges in U. of Michigan Case Skirted the Thorniest Issues
In politics, Americans expect different sides to talk past each other. In the courts, where argument is raised to the level of art, and opinions are issued replete with scholarly citations, the same phenomenon is considerably more disappointing.
On May 14, the U.S. Court of Appeals for the Sixth Circuit upheld the University of Michigan Law School's race-conscious admissions policy, ruling that the law school has a compelling interest in using the policy to diversify its student body.
