Judge Upholds Denial of Aid to Drug Offenders
A federal judge has dismissed a lawsuit challenging the constitutionality of a law that prohibits drug offenders from receiving federal aid, ruling that while the law may be unfair, it is not unconstitutional.
The U.S. Constitution "affords no right to a higher education," Judge Charles B. Kornmann of the U.S. District Court in Aberdeen, S.D., wrote in an opinion last month. "Likewise, there is no fundamental right to the receipt of federal student aid."
