Full Appeals Court Will Consider U. of Michigan Affirmative-Action Case
The U.S. Court of Appeals for the Sixth Circuit has decided that all nine of its judges, rather than a three-judge panel, should take up the appeals of two lawsuits challenging the University of Michigan's use of affirmative action in admissions.
In an order issued in October, the court postponed oral arguments in the two cases until December 6, when all nine of the court's judges can be present. The cases were to have been heard by a three-judge panel last week.
