Court Says 11th Amendment Shields Public Colleges From Some Lawsuits
The 11th Amendment shields public universities from some citizen lawsuits filed in federal court under the False Claims Act, a federal appeals court ruled last month.
The decision, which focused on Texas Tech University, said that such lawsuits were constitutional only when the federal government was more than a passive participant in the litigation.
