College Groups Petition Supreme Court to Preserve Patent-Law Exception
Some universities and higher-education organizations are rallying behind Duke University in asking the U.S. Supreme Court to overturn a ruling that limits the rights of academic researchers to use tools or inventions protected by patents.
In a petition to the court, the groups contend that the October 2002 ruling by the U.S. Court of Appeals for the Federal Circuit "will significantly increase the cost of basic research" at the very least, and in some cases "impede or altogether
